In order to participate as a member with The Business Referral Initiative, you must conform to our Terms and Conditions as listed below, after which reading though you will have therefore accepted that by submitting an application and we receive payment you are deemed to have become a registered member with us, which means you have accepted these Terms and Conditions under our Member Agreement.

 

The Business Referral Initiative is a registered business and is the business name under which all activity is undertaken. No persons or those purported to be liable have indemnity against these Terms and Conditions, nor do those using our website and related services directly or in part as in a proportion otherwise deemed as only in direct part or third party can avoid responsibility and are liable under any misuse or improper conduct as a Member.

Please understand that this agreement is to help keep The Business Referral Initiative as a safe and constructive environment to conduct matters as described in our Mission Statement, thus promoting trust and reliability among all members.

 

The following explains our terms on which The Business Referral Initiative offers accepting conditions in relation to our services.

 

This Agreement describes the Terms and Conditions that govern your accepted use of our services at any of our Chambers or of any use at our website http://www.thebri.com.au (this web site or where our services are displayed elsewhere on any other website) and our general guidelines.

 

You must read, agree with and accept all of the Terms and Conditions contained in this Member Agreement and the Privacy Policy to be a Member with our organisation, which include those Terms and Conditions expressly set out below and those incorporated by reference, before you may become a Member of The Business Referral Initiative. We strongly recommend that, as you read this Member Agreement, you also access and read the information contained in the other pages referred to in this document, as they may contain further Terms and Conditions which apply to you as a Member to The Business Referral Initiative. Please note, underlined words and phrases that are displayed in this document are click-through links to these pages under this agreement.

 

By accepting this Member Agreement, you also agree to be bound by the Member Agreements and posted Terms and Conditions of this website to any extent that you use this website, and its services.

 

These Terms and Conditions are set out to inform you of what you agree to and to do so as well as conform to our Mission Statement and also of what you may or may not do concerning activity within our entire structure.

We may amend these Terms and Conditions of this Agreement at any time at our discretion by posting the amended terms on this website. If these amendments have been made to the Member Agreement any participant of our service will also be able to find out through our announcements located on this website and we recommend regular visits to this website to keep yourself informed as is reasonable to suggest.  All amended terms shall automatically be effective 14 days after they are initially published on this website. If you do not agree with such changes, you must terminate your membership of The Business Referral Initiative at your cost and shall not be refunded your annual membership fee. If you do not terminate your membership you agree to the new terms and conditions. All new users to any amended Agreements and Terms and Conditions agree to the criteria and accept our Policies.

 

Our services are only available for, and are duly to be used by persons who are able to form legally binding contracts under applicable law. Without any limitation, our services are not available to persons under 18 years of age or either to any temporarily or indefinitely suspended members. If you cannot satisfy our Terms and Conditions, then please do not use our services. Your user ID regarding your membership when using this website is accepted as by us as solely your responsibility and your identity and may not be offered to any other party. We reserve the right to suspend or terminate your membership if we reasonably suspect that you have engaged in misconduct or activity in connection with our services or of use with this website.

 

1. Application for Membership

(a)  When you apply to become a member with The Business Referral Initiative you are registering your details with us and you are accepting our Privacy Policy to agree and to use the services on this website and of your responsible conduct in our Chambers, under which you also agree to our Mission Statement as well. Your membership fee is for a period of one year and when accepted will allow one year to endorse your particular profession in the Chamber with which you are applying membership for and is not refundable. It is your responsibility once your application is accepted and paid for to protect your particular industry within the Chamber you are applying for, and that you have understood our guidelines as displayed in this website’s link How it Works. You will agree also to the parameters of membership that apply under our guidelines of what does or does not protect your sole representation within any one particular Chamber within The Business Referral Initiative.

(b)  When you apply for membership and you are accepted, you are responsible for the security of your user name and password. You authorise us to assume that anyone using your user name and password is from your use or someone authorised by you. Unauthorised access and use of your details will, under no circumstances, negate your liability, as your ID is accepted by us as conduct on our website or forums as solely your responsibility. Therefore any actions under your user name and  business identity that has any connotation whatsoever is regarded as your use of this website, which may or may not result in whichever appropriate or agreed action, or for which the result from such use be our responsibility. You must notify us immediately if you become aware of any unauthorised use of your user name or password or of any other security breach.

(c)  You agree that you will not, in submitting your details for the use of, and of the privileges as a member and in using our services, use any false or misleading names or give false or misleading information, and notwithstanding which, your obligation to conduct yourself in any matters on this website or in a Chamber.  We reserve the right to terminate membership for any reasons whatsoever, and we are not responsible for information submitted by you of any false or misleading information.

 

(d)  If a government department, government agency or law enforcement agency informs us that there is any information on The Business Referral Initiative website which is in contravention of, or may contravene, any law, industry code of practice, policy guideline or regulation, we can remove that information from this web site and we are not responsible in any way for its content.  We also have the right to delete any correspondence, graphics or information displayed or any text summited through our forums or other pages on our website, which may or may not in any manner as we see or determine to be, as we reserve the sole judgment to decide on any action when concerning its content.

 

2. Ownership

This website at the domain www.thebri.com.au (website) is operated and owned by The Business Referral Initiative.

 

3. Acceptance of Terms and Conditions

Your access and use of the website and of your conduct within a Chamber is conditional. Your acceptance and compliance regarding these Terms and Conditions and the Privacy Policy for The Business Referral Initiative, is totally our discretion to decide upon.

By continuing to be a Member with us and of your use of the website and of the guidelines in any Chamber means you accept that you are bound by the website and of our Terms and Conditions.

 

4. Copyright

All intellectual property, data and content in the website which includes the text, graphics and images are owned by us or our recognised associates are absolutely considered our content and for our judgment only.

We regard the content of all correspondence in our website or together referred to as ‘Content’ for the purposes of this website or for the terms of use, or for which all Members and persons who are not Members is considered solely and in whole owned by The Business Referral Initiative.

Unauthorised use of any intellectual property in this website, or for any methods deemed as unauthorised copyright, which means we have not given permission for use of our content, shall be determined by subject to the conditions prescribed under appropriate law.
